Zimmer, Inc. has recently come under fire for allegedly manufacturing and selling a product to patients with harmful defects. The Zimmer product in question is the NexGen CR-Flex knee replacement system – a cementless high-flex femoral component implant that was allegedly not properly tested on patients before it was sold.
These assertions against Zimmer have led to 28 lawsuits in 13 federal jurisdictions and counting; some plaintiff attorneys believe that hundreds more are likely to be filed soon. Reasoning for Zimmer Knee MDL
Since the Zimmer NexGen CR-Flex knee implant was first manufactured in 2003, at least 150,000 implants have been sold. Some patients that have had a Zimmer knee replacement have allegedly experienced a failure of the implant earlier than the device’s expected 15-year span.
One study “The High Failure Rate of a High-Flex Total Knee Anthroplasty Design” presented at the 2010 American Academy of Orthopaedic Surgeons (AAOS) Annual Meeting showed a “high incidence of failure” of cementless high-flex femoral component. “39 of the 108 cases (36%) [were] loose. Moreover, many of these 108 cases (9.3%) have had revision or impending revision for painful loosening.”
Zimmer, Inc. has not taken action based on these findings, and has not acted on prominent orthopedic surgeons’ criticisms of the Zimmer knee devices. It is also interesting to note that no clinical data exists on the reliability of the Zimmer knee, since the FDA did not require clinical data prior to the device’s release to market.
